Terms and Conditions.

Article 1 – General provisions

The website www.amiamo-lagodicomo.com is operated by BV Laglio, with registered office at 2610 Wilrijk, Jachtlaan 14, registered in Register of Legal Persons of the central Database of Enterprises under corporate number 0809.954.057.

These general terms and conditions apply to every order by the Customer. “The Customer” is defined as “a natural person who enters into an agreement with Laglio BV, specifically the purchase of a product in the Amiamo Lago di Como webshop”.

Placing an order via the Amiamo Lago di Como website constitutes an express acceptance of these General Terms and Conditions, which are published on the website. No other conditions of exception apply if they have been accepted in writing by Laglio BV.

Laglio BV can change the conditions at any time. Any order after the adjustment assumes that the Customer has accepted the conditions.

If one of these provisions is not legally valid for whatever reason, the other conditions will remain fully applicable.

Article 2 – Price

All prices stated are expressed in euros, always including VAT and excluding all other taxes or duties to be paid by the Customer.

If delivery costs are charged, these will be borne by the Customer, unless expressly agreed otherwise.

Article 3 – Offer and order

Despite the fact that the webshop is compiled with the utmost care, it is always possible that the information provided is incomplete or not up to date. Obvious mistakes or errors in the offer do not bind Laglio BV. Laglio BV is under no circumstances liable in the event of manifest errors, typesetting or printing errors.

The offer is valid while supplies last and can be adjusted or withdrawn at any time by Laglio BV. Laglio BV cannot be held liable for the unavailability of a product.

The ordering procedure in the Amiamo Lago di Como webshop is defined as follows:

  1. The Customer selects the desired products and these are collected in an electronic shopping cart via the “add to shopping cart” button. You can pay from the shopping cart via the “proceed to checkout” button.
  2. The Customer is then asked to enter his contact details, the data is collected solely to send the order.
  3. The desired items will be delivered to the Customer via home delivery by Bpost or another postal company. A delivery fee will be charged for this service.
  4. By clicking the “place order and pay” button, the order is completed. As long as this button has not been clicked, the Customer has the option to change the order and the data entered.
  5. Once the order has been completed, the Customer will receive a confirmation of receipt of the order by e-mail. An order is completed when the financial transaction has been successfully completed.
Article 4 – Delivery

Laglio BV always strives to deliver its orders as quickly as possible. However, Laglio BV cannot under any circumstances be held responsible for any delay in the delivery of the products, nor for any damage that may result from this. However, the delay in delivery does not give the Buyer the right to terminate the agreement and cannot give rise to a claim for damages.

The place of delivery is the address that the Customer has communicated to Laglio BV.

Article 5 – Visible defects and non-conformity

Laglio BV guarantees that the products meet the specifications stated on the website and the existing legal provisions and/or government regulations on the date of order. However, Laglio BV is never responsible for the ultimate suitability of the products for each individual application by the Customer.

Any defects or incorrectly delivered products must be reported to Laglio BV by email amiamolagodicomo@gmail.com within 8 calendar days of delivery, otherwise they will be deemed to have been accepted. Returns of these products must be in the original packaging and still in new condition.

Article 6 – Hidden defects

The liability of Laglio BV for any hidden defects in the goods delivered by Laglio BV is limited to defects that manifest themselves within 2 weeks after delivery of the goods. Any hidden defects must in any case be reported in writing by the Buyer to the Seller by email amiamolagodicomo@gmail.com, under penalty of forfeiture of recourse, immediately and no later than within 48 hours after discovery of the defect. This notification must contain a detailed description of the defect. Complaints due to hidden defects do not suspend the payment obligation of the Buyer.

Article 7 – Privacy

By placing an order, the Customer declares that he has taken note of the privacy statement of Laglio BV.

Article 8 – Force majeure

Laglio BV is legally released and not obliged to fulfill any obligation towards the Customer in the event of force majeure.

Force majeure means the situation in which the execution of the agreement by one of the parties is prevented in whole or in part, temporarily or otherwise, by circumstances beyond the control of that party, even if this circumstance was already present at the time the agreement was concluded. The following cases are in any case considered force majeure (non-exhaustive): strike, fire, epidemic, high absenteeism due to illness, electrical, IT, internet or telecommunications disruptions and government decisions or interventions.

If Laglio BV invokes force majeure, it is not obliged to prove the irresponsible or unforeseeable nature of the circumstance that constitutes force majeure. In the event of force majeure, Laglio BV’s obligations will be suspended.

Article 9 – Warranty – Liability

Laglio BV is under no circumstances liable if damage is caused that is not only due to a defect in the product, but also to an error or negligence on the part of the Customer or a person for whom the Customer is responsible.

Except in the case of fraud or intentional error on the part of Laglio BV and/or its employees, the contractual and extra-contractual liability of Laglio BV towards the Customer is at all times limited to the invoiced value of the relevant defective good, excluding VAT.

Article 10 – Complaints

Any problems or complaints can be reported by email amiamolagodicomo@gmail.com to Laglio BV.

Complaints must always be reported within 8 calendar days after delivery or after the invoice date in the event of complaints regarding the invoice.

Article 11 – Miscellaneous provisions

Failure at any time by Laglio BV to enforce any of the rights listed in these terms and conditions, or to exercise any right thereof, will never be seen as a waiver of such provision and will never affect the validity of these rights. .

This agreement is subject to Belgian law. All disputes between parties regarding their agreement are settled amicably as much as possible. In the absence of an amicable settlement, only the court of the registered office of Laglio BV has jurisdiction.
